Important Disclaimer
MoveSnap generates inspection reports based on information, photographs, and notes provided by users. Reports are intended to assist with documenting property condition. MoveSnap does not provide legal advice, government certification, or independent certification. Whether a report is accepted as evidence depends on the requirements of the relevant landlord, insurer, tribunal, court, or other authority. Do not state or imply that reports generated by MoveSnap are government-approved, legally certified, or official.
While MoveSnap embeds timestamps and GPS coordinates to assist in creating verifiable evidence, we make no guarantees about the admissibility of documentation in legal proceedings, tribunals (such as NCAT or VCAT), or small claims courts. The effectiveness of documentation depends on local laws and individual circumstances.
1. Acceptance of Terms
By downloading, accessing, or using the MoveSnap application or website (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
MoveSnap provides tools to assist users in documenting property conditions. The Service allows you to capture timestamped photos, add notes, and generate PDF inspection reports.
3. User Responsibilities & Appropriate Use
You are responsible for all activity that occurs under your account. You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Service. You must not:
- Use the Service to generate fraudulent, misleading, or deceptive reports.
- Tamper with device timestamps or location data in an attempt to falsify inspection records.
- Upload or capture content that is illegal, offensive, or violates the privacy of others.
- Attempt to reverse engineer or disrupt the operation of the Service.
4. Intellectual Property
The Service and its original content, features, functionality, and design (including the "MoveSnap" name and logo) are owned by MoveSnap and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
5. Purchases and App Store Terms
One-Time Purchases: MoveSnap offers a one-time "Pro" unlock purchase to access premium features. Once purchased, you are granted a non-exclusive, non-transferable license to use the Pro features for the lifetime of the application.
App Store Purchases: All purchases made through the Apple App Store, and your license to use the application, are governed by Apple's standard End User License Agreement (EULA) and terms of service.
Refund Policy: Because all transactions are processed entirely by Apple, MoveSnap does not have the ability to issue refunds directly. Any refund requests are subject to Apple's policies and must be processed through Apple Support.
6. Your Data and Backups
You retain full ownership of all data you create in MoveSnap, including photographs, notes, and PDF reports. Because MoveSnap does not collect, store, or transmit your data to our servers (all data is stored locally on your device or personal iCloud), you are solely responsible for backing up your data. We are not liable for any data loss due to device failure, app deletion, or other causes.
7. Indemnification
You agree to indemnify, defend, and hold harmless MoveSnap, its developers, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the application, your generated reports, any rental disputes, or your violation of these Terms of Service.
8. Limitation of Liability
To the maximum extent permitted by applicable law, MoveSnap and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.
9. Account Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service. Upon termination, your right to use the Service will immediately cease.
10. Updates to the Service
We reserve the right to withdraw or amend our Service, and any service or material we provide, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction where the developer resides, without regard to conflict of law principles.
12. Entire Agreement
These Terms of Service, together with our Privacy Policy and Apple's EULA, constitute the entire agreement between you and MoveSnap regarding the use of the app.
